1. Acceptance of Terms

By using fishsandals.com or buying from it you agree to these terms. If you do not agree to them, do not use the site.

2. Who operates this store

Not published yet. The legal entity behind this shop, and its registered address, are not stated on this page because neither has been confirmed. That is a real gap in a document of this kind and it is named here rather than left for you to notice. Privacy says the same.

3. What the Service is

Fish Sandals is an online shop that sells novelty sandals to delivery addresses in the United States, priced in US dollars. There are no accounts, no subscriptions and nothing to sign in to; every purchase is a guest checkout. The site is provided “as is” and we may change, suspend or discontinue any part of it.

4. Orders, prices and payment

• Prices are in US dollars. The price shown is the price charged: no postage, handling or insurance fee is added, and no sales tax is collected, because this shop holds no state sales-tax registration.
• Every line is re-priced by the server from the catalogue before payment is taken, so a price altered in your browser has no effect on what is charged.
• Payment is taken by Stripe on its own pages. Placing an order is an offer; we may decline it, in which case nothing is charged.
• No ship-by date is published. Where a seller states no shipping time, the FTC Mail Order Rule (16 CFR Part 435) requires shipment within 30 days of a properly completed order and a delay notice before that deadline if it will be missed. Those obligations apply to us. Shipping sets them out.
• A paid order that has not been dispatched can be cancelled from order lookup.

5. Acceptable use

You agree not to:

• Use the site for any unlawful purpose
• Attempt to gain unauthorised access to any part of it
• Interfere with or disrupt it or its infrastructure
• Submit malicious code or content
• Impersonate any person or entity
• Scrape, crawl or spider it without written permission
• Use the contact form to send spam or unsolicited commercial messages

6. Intellectual property

The text, drawings, layout and code of this site are owned by the operator of Fish Sandals or its licensors and are protected by copyright and trademark law. You may not reproduce, distribute or create derivative works from them without written permission.

7. What we do not claim about the goods

No supplier specification sheet or wear test has been published for these designs. The catalogue therefore states cut, closure, structure and colourway and nothing else: no material, and no performance claim. Nothing on this site should be read as a warranty that the sandals are slip-resistant, quick-drying, supportive or suitable for any particular activity, because no such testing exists to support one.

8. Limitation of liability

To the fullest extent the law permits, we are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill, arising from your use of the site. Our total liability will not exceed what you paid us in the twelve months before the claim. Nothing in this section limits liability that cannot lawfully be limited.

9. Disclaimer of warranties

The site is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement — except any warranty your state's law gives you that cannot be disclaimed.

10. Governing law

No choice of law or venue is asserted. An earlier version of this page named the Province of Ontario, Canada, which was left over from a Canadian storefront and is not right for a shop selling into the United States. It has been withdrawn rather than replaced, because naming a forum on behalf of an entity this page cannot yet name would be inventing the most consequential term on it. Nothing here limits the rights you have under the law of the state where you live.

11. Changes to these terms

We may update these terms. The date at the top of this page is when it last changed, and it is kept accurate. The terms that govern an order are the ones published when the order was placed.
